1. NATURE AND APPLICABILITY

These Terms & Conditions ("Terms") govern the use of the HomeoHub platform. By accessing, registering, or using the platform, you agree to be bound by these Terms along with all applicable policies. If you do not agree, you must discontinue use immediately.

2. PLATFORM ROLE, PRACTITIONER ASSIGNMENT, AND LIABILITY

2.1 Platform Description: HomeoHub is a healthcare coordination platform providing online consultations, treatment programs, follow-up services, and medicine delivery through a curated network of qualified practitioners. HomeoHub does not function as a hospital and does not directly provide medical treatment. 2.2 Operational Responsibility: HomeoHub assumes operational responsibility for service delivery, practitioner assignment, and package fulfillment strictly to the extent explicitly stated at the time of purchase or enrollment. 2.3 Practitioner Independence and Medical Liability: All medical advice, clinical diagnosis, prescriptions, and treatment decisions are rendered independently and solely by the assigned practitioner. HomeoHub does not interfere with, supervise, or control the clinical judgment of any practitioner. In the event of any medical error, misdiagnosis, incorrect prescription, or professional negligence attributable to the practitioner, the liability therefor shall vest exclusively with the concerned practitioner. HomeoHub shall bear no liability, direct or indirect, for any act, omission, or professional conduct of the practitioner. 2.4 Practitioner Assignment and User Consent: The assignment of practitioners to users is carried out solely at the discretion of HomeoHub, based on parameters including but not limited to availability, area of expertise, and case suitability. Users acknowledge that by proceeding to avail the services offered by HomeoHub, they expressly consent to and accept the practitioner assigned to them. 2.5 No Refund on Practitioner Preference: Once a service has been availed or a treatment package has been initiated, users shall not be entitled to claim any refund, compensation, or relief on grounds of personal preference, perceived qualification, subjective assessment of quality, or dissatisfaction with the assigned practitioner. HomeoHub shall bear no liability whatsoever arising from such subjective assessments. 2.6 Grievance Redressal: Any grievance pertaining to practitioner performance or professional conduct shall be reported exclusively through HomeoHub's internal grievance redressal mechanism. HomeoHub shall endeavour to address such grievances in a fair and timely manner.

3. TELEMEDICINE CONSENT

By using the platform, you provide informed consent for telemedicine services in accordance with applicable laws including the Telemedicine Practice Guidelines issued by the Central Council of Homoeopathy on April 10, 2020. You acknowledge that consultations are conducted remotely and that physical examination is not possible. You understand that technical issues may occur and that diagnosis depends on the accuracy of information provided by you.

4. SCOPE OF SERVICES

HomeoHub provides healthcare services including online consultations through video, audio, and chat, treatment programs, follow-up services, and medicine delivery where applicable. Services are limited to those explicitly stated at the time of purchase or booking.

4A. AI-ASSISTED DIAGNOSIS — DR. INTELLIGENT

4A.1 HomeoHub operates an AI-assisted health guidance service named Dr. Intelligent ("the AI Service"). The AI Service analyses symptoms, medical history, and user-provided information to generate informational health guidance. 4A.2 The AI Service is NOT a licensed medical practitioner and does not hold any medical registration. Outputs from the AI Service: (a) Do not constitute a medical diagnosis, clinical prescription, or professional medical advice; (b) Are not a substitute for professional medical consultation with a qualified practitioner; (c) Must not be used as the sole basis for any medical decision, including initiation, discontinuation, or modification of any treatment. 4A.3 HomeoHub explicitly disclaims all liability, direct or indirect, for any harm, loss, adverse outcome, or injury arising from a user's reliance on AI-generated health information without independent consultation with a qualified practitioner. 4A.4 The AI Service may direct users toward appropriate practitioners, diagnostic tests, or specialists. Such recommendations are informational and do not constitute binding clinical referrals. 4A.5 By using the AI Service, users consent to their consultation data being logged and stored for continuity of care and platform safety monitoring.

5. USER OBLIGATIONS

By using HomeoHub, users undertake the following obligations: 5.1 Accuracy of Information: Users must provide accurate, complete, and up-to-date personal, health, and identity information at all times. Providing false or misleading information is a material breach of these Terms and may result in immediate suspension of account. 5.2 Account Security: Users are solely responsible for maintaining the confidentiality of their account credentials, M-PIN, and OTP. Users must not share their login credentials, OTP, or M-PIN with any third party. HomeoHub shall bear no liability for any loss or unauthorised access arising from a user's failure to safeguard their account credentials. 5.3 Single Account: Each individual must maintain only one HomeoHub account. Creating multiple accounts is a violation of these Terms. 5.4 Prohibited Conduct: Users must not: (a) Impersonate any person or entity or misrepresent affiliation with any person or entity; (b) Use the platform for any unlawful, fraudulent, or malicious purpose; (c) Attempt to gain unauthorised access to any part of the platform or its systems; (d) Upload, transmit, or distribute harmful, defamatory, obscene, or illegal content; (e) Reverse-engineer, decompile, or scrape any part of the platform; (f) Use automated tools to access the platform without HomeoHub's prior written consent. 5.5 Any failure to comply with these obligations may result in restriction, suspension, or permanent termination of services without refund.

6. APPOINTMENTS AND NO-SHOW POLICY

Appointment fees are strictly non-refundable. If a user fails to attend a scheduled consultation for any reason, no refund shall be provided. Rescheduling may be permitted at the sole discretion of HomeoHub subject to availability.

7. TREATMENT PACKAGES

Treatment packages are valid only for the specified duration and include only the services mentioned at the time of purchase. Medicines once delivered are non-returnable. In case of loss, damage, or misuse of medicines, replacements shall be chargeable.

8. PAYMENT TERMS

Full payment is required before services are initiated. A payment shall be considered complete only when the full amount is received in HomeoHub's official account. If a transaction fails, remains pending, or is reversed, services may not be provided.

9. INTERNATIONAL USERS

Users outside India may access HomeoHub services via telemedicine. Such users are solely responsible for ensuring compliance with the laws and regulations of their respective countries. All payments shall be processed in Indian Rupees (INR). Any currency conversion charges, banking fees, or international transaction costs shall be borne exclusively by the user. Refunds, if applicable, shall be limited to the INR amount received by HomeoHub.

10. REFUND AND MONEY-BACK

Refunds are governed strictly by the Refund & Money-Back Policy published on the platform. Users must comply with all conditions specified therein to be eligible for a refund. No alternative, substitute, or exchange shall be permitted in lieu of a refund unless expressly stated in the applicable policy.

11. COUPON POLICY

Coupons and promotional offers may be applied subject to eligibility criteria. Only one coupon may be used per transaction. Coupon value is non-refundable and cannot be applied retrospectively to completed transactions.

12. PLATFORM RIGHTS

HomeoHub reserves the right to assign or change practitioners, modify treatment plans, cancel or reject treatment before initiation with applicable refund, and suspend or terminate user access in case of policy violations.

13. TREATMENT LIMITATIONS

Services provided through HomeoHub are not a substitute for emergency medical care. In case of a medical emergency or serious condition, users must seek immediate in-person medical assistance.

14. DATA USAGE AND PRIVACY

User data may be collected and processed for purposes of treatment, platform operations, analytics, and research in anonymized form, in accordance with HomeoHub's Privacy Policy and applicable laws including the Digital Personal Data Protection Act, 2023. HomeoHub shall implement appropriate technical and organizational measures to safeguard user data against unauthorized access, disclosure, or misuse.

15. HOMEOHUB UNIVERSAL LIVING IDENTITY (HH-ULI)

15.1 HomeoHub assigns each user a unique, permanent identifier known as the HomeoHub Universal Living Identity ("HH-ULI") in the format HH-H-XXXXXXXX. The HH-ULI serves as the singular anchor for all health records on the platform throughout the user's lifetime. 15.2 The HH-ULI belongs to the individual and not to any account, guardian, or custodian. It cannot be transferred to another person, sold, or reassigned. 15.3 Upon the confirmed death of a HH-ULI holder, the identifier is permanently retired and is never reassigned to any other individual. 15.4 HomeoHub reserves the right to expand the HH-ULI system in future to encompass dependent profiles for minors and, in due course, animal and plant health registrations under extended identifier formats.

16. SINGLE ACCOUNT OBLIGATION AND DUPLICATE ACCOUNT PROHIBITION

16.1 Each individual may hold only one active HomeoHub account. The creation of duplicate accounts — whether through different mobile numbers, email addresses, devices, or identity documents — is strictly prohibited. 16.2 Users must ensure that all information provided at registration and during profile setup is accurate, current, and genuinely their own. 16.3 If a user inadvertently creates a duplicate account following a forgotten password or change of contact details, they must contact HomeoHub at info@homeohub.in to initiate an account merging process rather than continuing to use multiple accounts. 16.4 HomeoHub employs automated detection mechanisms including government ID cross-matching, profile similarity analysis, and device fingerprinting to identify duplicate accounts. Detection of deliberate duplicate account creation may result in: (a) Suspension of all associated accounts; (b) Forfeiture of paid services without refund; (c) Reporting to relevant authorities in cases of suspected fraud.

17. CUSTODIAN RESPONSIBILITIES AND GUARDIAN OBLIGATIONS

17.1 Where a user manages health records for a minor, dependent, or incapacitated person ("Dependent"), the account holder acts as a Custodian and not as the owner of the Dependent's health records. 17.2 Custodians are responsible for: (a) Providing accurate health and identity information for the Dependent; (b) Ensuring that consultations, prescriptions, and treatments are in the best interest of the Dependent; (c) Maintaining the confidentiality of the Dependent's health information; (d) Designating an Emergency Nominee who may assume custodian access in the event of the Custodian's death, incapacity, or unavailability. 17.3 Multiple custodians may be designated for a single Dependent, such as both parents. Where custodians disagree on treatment decisions, HomeoHub may suspend services pending resolution and bears no liability for delays arising from such disputes. 17.4 If a Dependent profile is created on multiple accounts, such as independently by both parents, HomeoHub will treat these as duplicate records and initiate a merging process upon detection or upon request.

18. HEALTH RECORD TRANSFER AND SUCCESSION

18.1 Transfer on Maturity: When a Dependent registered as a family member attains the age of 18 years and creates an independent HomeoHub account, their complete health record accumulated under the custodian's account may be transferred to their own HH-ULI upon request and successful identity verification. 18.2 Transfer on Custodian Death: In the event of the death of the sole Custodian, health records shall be transferred to the designated Emergency Nominee upon submission of a valid death certificate and proof of identity. If no nominee is designated, HomeoHub will accept transfer requests from verifiable next-of-kin with appropriate legal documentation. 18.3 Transfer on Divorce or Separation: In the event of divorce or legal separation, custodian access may be restructured upon submission of a valid court order specifying custodial arrangements. HomeoHub will endeavour to process such requests within fourteen (14) working days. 18.4 Records are never deleted as a consequence of custodian transfer. All historical health data is preserved and transferred intact. 18.5 HomeoHub assumes no legal liability for disputes arising between custodians regarding access to or custody of health records. Users are advised to resolve such disputes through appropriate legal channels before seeking platform-level record transfers.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HomeoHub shall not be liable for treatment outcomes, medical complications, acts or omissions of practitioners, failures of third-party services, or technical disruptions of any nature. All services are provided on a best-effort basis without any express or implied warranties of fitness, merchantability, or guaranteed outcomes.

19A. DATA BREACH AND CYBER SECURITY LIABILITY DISCLAIMER

HomeoHub deploys industry-standard security measures to protect user data. However, by using the platform, users expressly acknowledge and agree that: 19A.1 No digital system is entirely immune to cyber threats. HomeoHub makes no warranty, express or implied, that the platform, its databases, or its infrastructure are impenetrable or free from security vulnerabilities at all times. 19A.2 HomeoHub shall bear absolutely no liability, financial or otherwise, for any loss, unauthorised access, theft, corruption, exposure, or misuse of personal data arising directly or indirectly from: (a) Cyber attacks, hacking, distributed denial-of-service (DDoS) attacks, or intrusion by malicious third parties; (b) Ransomware, malware, spyware, phishing, or social engineering attacks; (c) Vulnerabilities in third-party cloud infrastructure, hosting services, or internet networks not within HomeoHub's direct operational control; (d) Nation-state cyber attacks, government-directed cyber warfare, or large-scale coordinated infrastructure failures; (e) Compromise of the user's own device, operating system, browser, or network; (f) Disclosure arising from the user sharing, losing, or failing to protect their login credentials. 19A.3 In the event HomeoHub becomes aware of a significant data breach affecting user data, HomeoHub will take all commercially reasonable steps to contain the breach, assess the impact, and notify affected users and applicable regulatory authorities as required by law. Such notification shall not constitute an admission of fault, negligence, or liability on the part of HomeoHub. 19A.4 Users are strongly advised to use strong, unique passwords, enable device-level security, and refrain from accessing the platform over unsecured public networks. HomeoHub shall not be responsible for any data compromise attributable to the user's own security practices.

20. INDEMNITY

Users agree to indemnify and hold HomeoHub, its officers, employees, and affiliates harmless against any claims, damages, losses, or liabilities arising from misuse of the platform, violation of these Terms or applicable policies, or provision of inaccurate or incomplete information.

21. FORCE MAJEURE

HomeoHub shall not be held liable for any delay or failure in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government-imposed restrictions, power failures, internet disruptions, or server outages.

22. DISPUTE RESOLUTION AND ARBITRATION

In the event of any dispute arising out of or in connection with these Terms, the parties shall first attempt resolution through HomeoHub's internal grievance redressal mechanism. If unresolved within thirty (30) days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue shall be Ahmedabad, Gujarat. Arbitration shall be conducted in English by a sole arbitrator mutually appointed by the parties.

23. SUSPENSION AND TERMINATION

HomeoHub may suspend or terminate user access in case of policy violations, fraudulent activities, or misuse of services, without prior notice and without liability to the user.

24. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India.

25. JURISDICTION

Subject to the arbitration clause above, all disputes that proceed to litigation shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat.

26. ELECTRONIC AGREEMENT

26.1 By accessing or using the HomeoHub platform, clicking "I Agree," checking a consent checkbox, or completing registration, you enter into a legally binding contract with Homeohub Healthcare Private Limited. This constitutes a valid and enforceable electronic contract in accordance with Section 10A of the Information Technology Act, 2000. 26.2 Your IP address, device information, and the timestamp of your acceptance are recorded at the time of agreement. This data is admissible as evidence of your acceptance under Section 65B of the Information Technology Act, 2000. 26.3 You expressly waive any right to claim that you were unaware of these Terms or that you did not accept them, once you have completed registration or login on the platform. 26.4 If you do not agree to these Terms, you must immediately discontinue use of the platform and all its services.

27. INTELLECTUAL PROPERTY

27.1 All content, materials, features, and functionality on the HomeoHub platform — including but not limited to text, graphics, logos, icons, images, software code, AI models, treatment frameworks, diagnostic tools, and the HomeoHub Universal Living Identity (HH-ULI) system — are the exclusive property of Homeohub Healthcare Private Limited and are protected under applicable intellectual property laws including the Copyright Act, 1957 and the Trade Marks Act, 1999. 27.2 Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for personal healthcare purposes. This licence does not permit: (a) Copying, reproducing, or distributing any platform content; (b) Reverse-engineering, decompiling, or extracting the source code of any platform component; (c) Creating derivative works based on platform content or AI outputs; (d) Using HomeoHub's trademarks, logos, or branding without express written consent. 27.3 AI-generated treatment plans, diagnostic summaries, and health reports produced by Dr. Intelligent on behalf of a user remain the property of HomeoHub but are licensed to the user for personal use. They may not be republished, sold, or commercially exploited. 27.4 Any unauthorised use of HomeoHub's intellectual property may result in legal action including claims for damages, injunctive relief, and recovery of legal costs.

28. SEVERABILITY

If any provision of these Terms is held by a court or competent authority to be invalid, unlawful, void, or unenforceable to any extent, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect to the maximum extent permitted by law. The invalid provision shall be replaced by a valid provision that most closely achieves the original intent and economic effect of the severed provision.

29. ENTIRE AGREEMENT

These Terms, together with HomeoHub's Privacy Policy, Refund Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Homeohub Healthcare Private Limited with respect to your use of the platform. These Terms supersede all prior agreements, representations, warranties, and understandings — whether written or oral — relating to the same subject matter. No verbal promise, marketing representation, customer support communication, or prior course of dealing shall form part of this agreement unless expressly recorded in a written amendment signed by a duly authorised representative of HomeoHub.

30. AMENDMENTS

HomeoHub reserves the right to update or modify these Terms at any time without prior notice. Revised Terms will be published on the platform with an updated effective date. Continued use of the platform following any modification, or re-acceptance of these Terms at login, shall constitute the user's binding acceptance of the updated Terms. Users are encouraged to review these Terms periodically.
